1. GENERAL INFORMATION

These General Terms and Conditions exclusively govern the relationship between Roldiwines.com and the users/customers of the online store Roldiwines.com who place orders for products in Spain (including the Balearic and Canary Islands), France (mother country) and Switzerland.

2. Subject matter and scope of application

These Terms and Conditions serve to define the rights and obligations of the parties in the context of the online purchase and sale process of wines, spirits and related products (hereinafter “the Products”) offered on the Website.

Acceptance of these terms and conditions by the customer is an essential prerequisite for placing an order. It is assumed that the customer accepts the terms and conditions in full at the time of order confirmation.

3. AUTHORIZATION AND ABILITY TO PURCHASE

In order to make a purchase, the customer declares that they are over 18 years of age and have full legal capacity to enter into contracts. For products with a higher alcohol content, stricter age verification may be required at the time of delivery.

The customer undertakes to provide truthful and accurate contact details that are necessary for processing the order.

4. Purchase process and prices

  • Catalog and prices: The products are displayed with their description, characteristics and price in euros (€) including taxes (VAT). Prices may vary; the prices valid at the time of order confirmation apply.
  • Shipping costs: These are clearly and in detail listed before the final payment confirmation. They vary depending on the destination (Spain, France or Switzerland), weight and volume of the order.
  • Taxes and customs duties:
    • Deliveries to Spain and France: All prices include VAT in accordance with Spanish law.
    • Deliveries to Switzerland: All prices include VAT applicable under Spanish law. The customer is the registered importer and is responsible for paying any duties, taxes (Swiss VAT) or import charges that the Swiss authorities may impose at the time of delivery. Roldiwines.com accepts no liability for these charges.
  • Ordering: The ordering process takes place by selecting the products, adding them to the shopping cart and proceeding to the checkout. After entering the data and selecting the payment and delivery conditions, the customer receives an e-mail confirming receipt of the order (this does not yet constitute acceptance).
  • Confirmation and Acceptance: The sale is not considered formally completed until Roldiwines.com sends the customer an email confirming shipment of the order. We reserve the right not to accept orders due to pricing errors, stock shortages, payment verification issues or problems with the delivery address.

5. Payment methods

The following payment methods are accepted: Credit/debit card (via a secure, encrypted interface), PayPal and bank transfer. In the case of a bank transfer, the order will be processed as soon as the payment has been received and confirmed.

6. DELIVERY AND TRANSPORTATION

  • Delivery times: Delivery times are estimates and begin with the shipping confirmation. We accept no liability for delays caused by the carrier or by customs procedures (especially in Switzerland).
  • Place of delivery: Delivery is made to the address specified by the customer. An exact address and a telephone number for queries are essential.
  • Receipt: It is mandatory to check the condition of the products upon receipt. Any defects (breakage, shortages, visible damage to the packaging) must be noted immediately on the carrier’s delivery bill and reported to our customer service department within a maximum of 24 hours. Complaints regarding externally invisible damage must be reported within 48 hours of receipt.
  • Risk: The risk of loss or damage to the products is transferred to the customer at the time of physical delivery.

7. RIGHT OF WITHDRAWAL (only for consumers in the EU)

In accordance with consumer protection laws, if the customer is a finalconsumer(a natural person acting outside their professional activities)and resides in the European Union (Spain, France), they have the right to withdraw from the contract within 14calendar days ofreceipt of the products without giving any reason.

IMPORTANT EXCEPTION: In accordance with article 103(m) of Royal Legislative Decree 1/2007, there is no right of withdrawal for the sale of alcoholic beverages whose price was agreed at the time of contracting, which cannot be shipped within 30 days and whose value is subject to market fluctuations. As our products (wines and spirits) fall into this category, WE DO NOT ACCEPT RETURNS BASED ON THE EXERCISE OF THE RIGHT OF WITHDRAWAL, unless the product received does not correspond to the order or is faulty (see next point).

8. WARRANTIES AND RETURNS OF DEFECTIVE ITEMS

Roldiwines.com guarantees that the products correspond to the description and are free of conformity defects at the time of delivery. If the product:

  • It does not correspond to the order.
  • Arrives defective or in poor condition (e.g. cork taste that has spoiled the wine, broken bottle).
  • Does it have any hidden defects?

The customer must notify us within a maximum of 48 hours of receipt and send clear photos and a description to our customer service department. After inspection, we will, at our discretion, either replace the product or refund the amount paid. The cost of the return shipment will be covered by Roldiwines.com in these cases.

9 Intellectual and industrial property

All contents of the website (texts, images, logos, trademarks) are the property of Roldiwines.com or its licensors and are protected by intellectual and industrial property rights. Reproduction without express permission is prohibited.

10. PROTECTION OF PERSONAL DATA

The personal data provided will be processed in accordance with our Privacy Policy, which complies with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on Data Protection. The main purpose is to manage the order and the commercial relationship. The customer may exercise their rights of access, rectification, erasure, restriction, objection and portability by submitting a request to our Data Protection Officer at the email address indicated in the Privacy Policy.

11. Applicable law and dispute resolution

These conditions are governed by Spanish law and must be interpreted accordingly, in particular taking into account the specific Catalan regulations on consumer protection and trade.

For all disputes, both parties submit, expressly waiving any other jurisdiction, to the courts of the city of Girona, Catalonia, without prejudice to the consumer’s right to apply to the courts of his domicile.

12. CHANGES

Roldiwines.com reserves the right to change these terms and conditions. The terms and conditions published on the website at the time of ordering shall apply.
